Downey, CA asked in Employment Discrimination and Employment Law for California

Q: Do I need a medical release form to return to work?

I live in California. I called in sick 4 days.I have paid sick pay 3 days.I came in to work the next monday and they sent me home. Employer said I need a medical release form in order to work again. Is this accurate. I did not even go to the doctors. I had a stomach flu but I do not like going to the doctors unless it's an emergency.

A: Your employer may require a medical release form indicating that you have been released to return to work. However, since you did not go off work on a doctor's orders you don't have a doctor's release to return to work. Have you spoken with your supervisor? Call the HR department and explain your situation. If that doesn't work, go to an urgent care clinic and get a release to return to work.
