San Antonio, TX asked in Car Accidents, Personal Injury, Employment Law and Workers' Compensation for Texas

Q: Is this something is like follow up with a lawyer? I feel like the managers are treatingme unfairly because of the claim

HR filed a workmans comp claim for an injury. first issue is that I don't feel like my employer is following the restrictions from my doctor. And my second issue is I'm on a medication that the doctor provided on the restrictions list to my employer. It stated the medication can make me drowsy. And no driving. I took the medication a few hours before work because of my back pain. Due to that medication I overslept 2 hours into my shift. When I woke up my back was still in pain. I immediately called my manager and advised that because of my medication I overslept and I'm in horrible pain and I need to see my doctor about my injuries. My manager then said I still need to come in. I emailed and texted his manager. No response. I called my manager back and asked for a personal day to see my doctor. His reply was there will be reprocusions. Fast fwd to this week. I get called into his office. Hethenmakesme sign a write up. I toldhim I don't agree w/ it , but in fear of losing my jobI signd

A: You should contact a member of the Texas Trial Lawyers Assn who handles workers compensation and employment related issues--they give free consults.Your oversleeping is on you. Yes it is due in part to the medication but you are responsible for being up and out. But you need some specific guidance so get an in person consult.
