A: You can file a paternity lawsuit in CA Family Court and formally serve them on the child's other parent, seeking parental rights including having your name on the child's birth certificate. A: To add on to Ali's comment, adding a parent's name to a birth certificate can be a two-part process. First, parentage or paternity has to get established in the family courts with a paternity or parentage case. Then, the court order resulting from that case is used to get the name added. The adding of the name is not done in the courts, but rather through the Department of Public Health in Sacramento.
