Q: Can my divorce proceedings be moved from Florida to Illinois if now my husband has relocated to Illinois?

Divorce was filed by him in Florida, June 2016. We have 1 child together. I was granted relocation to Illinois with child November 2016. No visitation order or child support order is in place, this has been going on 8mths now, with no support. He is now relocating to Illinois as of this week. Lawyers are stating we cannot move case here unless he dismisses case.. I cannot afford this attorney any longer. Need help asap for legal aid, and child support issues.

A: The lawyers are correct. Jurisdiction was vested in fl when the case was filed. I would suggest that you hire a lawyer here and file here. Fl should be confronted about declining jurisdiction. Until then, u cannot proceed in il. It is a procedural issue though. I can't imagine that a court would divest itself of jurisdiction.
