Ocala, FL asked in Civil Litigation, Contracts and Landlord - Tenant for Florida

Q: I signed a lease 5 days before they changed mangement and the new management will not honor the lease or deposit.

The previous management was stealing the money and not paying the owners. I have a key and everything. Now the new management company wants me to repay the deposit the i gave already. And they are telling me i have to redo the lease. I signed the lease and gave the deposit on May 3 but corrections were made and we signed the corrected lease on May 6. They fired him on May 9. At first they wouldnt even acknowledge the lease. I have text messages and written receipt that i paid the $850 deposit. Apparently they had a court date last week amd none of the tenants knew about it. I was referred to him from a friend who was also renting from this guy for 8 months. It was confirmed through new management that he was over the property's and that the owners no longer want any dealings with him. What are my rights? By law, must they honor the lease?

A: You provided just too little information.

Your situation could be that the "manager" was in fact an unauthorized person stealing the rent for property he had no legal ability to rent. Or it could be the owner and the old manager had a falling out and parted ways.

The court date is confusing as you have not stated what that case is about.

Give more information to be able to find some advice.

A: My suggestion is that you may want to have a consultation with a real estate attorney to go over the situation to determine what if anything might need to be done in this case. I do not think that you should have to pay twice, but I suggest getting a lawyer involved now may help if the new management company tries to evict you claiming that you did not comply with the lease.
