Q: I received a lawsuit stating that I was driving the car that crashed into another I was 60 miles away How do I proceed?

My cousin was driving my brothers truck, which i'm insured for. No police report was written.

A: It's great that you have insurance. Turn over the lawsuit papers to your insurance company right away. They will provide you with a lawyer and a defense.

A: Notify your insurer. It will appoint an attorney to represent you and establish that you weren't driving. As owner of the vehicle, you are still liable for permissive use of the vehicle up to statutory limits of $15k/person, $30k/accident.

A: I suggest you talk to a personal in jury lawyer because you were not driving the vehicle. The appropriate parties to these lawsuits would be your brother and your cousin. Or better yet, turn it over to your brother;s insurance company.Best of luck.

A: There are letter demands and there are lawsuits. Assuming you received suit papers, you make copies. You immediately call your brother's insuirance. You 1) send an email confirmation; 2 )fax them copies of the suit papers with the claim number at the top of each page, 3)you then send the suit papers certified return receipt. At each stage you give all of your contact information. If youi have your own insurance notify that. Your cousin should notify both. It's not a huge deal to substitute parties.
