Los Angeles, CA asked in Consumer Law, Contracts and Collections for California

Q: Unpaid and overdue personal loan with signed note for $15,5k due in 2008 with 12.5 annual interesr

Is the statue of limitations up? The last payment he made was less than a year ago have not heard from him since despite a few attempts. Although he did write that he would pay off soon but this was like 2 years back and since then maybe three 50$ payments. Been very very very patient and sympathetic to his situations with always having hard times, same story every year. Ive had enough of this and want what he owes and ASAP this money is desperatly needed and was taken out of a cd fund to loan this predator. The man has a few different businesses currently still operating I believe. He is a swindling very high member of a local religous congregation, which are not even suppose to ask for personal loans in the first place. I would even be happy to donate any recovered funds if I wasn't able to receive any myself would be better than him getting away with it.

A: Hire an attorney and bring a lawsuit. Max in Small Claims is $10k, so that won't work.
