Corona, CA asked in Car Accidents for California

Q: I was involved in a small car accident i was at fault. The damage to the other persons car was about $150.00

My insurance offered them about $1100.00 They claimed injuries and did not accept. after about 2 years they take me to small claims. The judge awarded the same amount the insurance company was offering. So now I have a judgement on my credit report affecting my credit rating. I work very hard to maintain my credit in good status. Is there anything i can do? I just seams wrong that I follow the law, I have a good policy and still I'm kind of not really protected. The insurance company did pay the other party right away. I already got a notice from one of my credit cards saying that due to derogatory, collection judgement which is due to this judgment they were lowering my limit. this could also affect me in many other ways, what can I do please help and thank you in advanced.

A: It seems the judgment is still appearing as unpaid, even though your insurance company took care of it. First, see if they obtained a "satisfaction of judgment" signed by the plaintiff at the time they paid them. They should have, and should have filed it. If not, they should do so now. If necessary, you can send one directly to the plaintiff, along with a letter explaining that they must return it or you will be forced to take them to court. Once it is filed, you will need to contact the credit bureaus and your creditor(s) and correct or explain the situation.

A: If a Satisfaction of Judgment has been filed, you have no basis to object. You hurt someone and incurred a liability that appears on your credit. Your insurer had the right to a jury trial and so did the plaintiffs.
