Rochester, NY asked in Employment Discrimination and Employment Law for New York

Q: Unable to find employment due to background checks from an incident that ocurred in 2008.

In 2008, in Oklahoma, I received a misdemeanor charge. It became a felony when I was unable to pay the fines. While applying for a job with the City of Rochester, the background check revealed this and U.S. Marshall's arrested me. Oklahoma does not want to extradite me however they refuse to drop the charges. Will I continue to be arrested with each job search? Also I can not receive social services because I can't provide DSS with a valid address. The apt is in my wife's name and the landlord refuses to add me to the lease and refuses to fill out a landlord-tenant agreement so in the eyes of DSS I am homeless. In order to get benefits I would have to seperate from my family and enter in a homeless shelter.

A: Maybe.

You probably need to hire an Oklahoma criminal defense lawyer. Something needs to be done about the felony in Oklahoma. Since I do not practice criminal law that is a question for criminal defense counsel.

Once you clear up Oklahoma, New York should no longer be an issue.
