Q: Do I have a racial discrimination case for the following occurrences? Due to limited characters, I must list less facts.
1. I am the only Hispanic woman at the company (employed 15 mos). There are approx 12-13 total employees.
2. All female employees are of Asian ethnicity and are allowed to wear jeans etc. everyday Mon-Fri.
But only I was verbally prohibited from wearing jeans, even on "Casual Fridays" when jeans are allowed in our Company's Employee Handbook.
3. I am consistently asked to undergo physically strenuous jobs outside of my department and outside of the clerical job description I was hired for, involving heavy lifting and resulting in chronic lower back and neck pain. Recent x-ray results revealed disc deterioration between the vertebrae in the lower back and neck areas of my spine.
4. During my initial job interview, the hiring manager said he would only hire me at $45,000 annually, since that was what I was making prior, even though he was initially offering $50,000 annually for my position. Via email, he agreed to consider raising my salary after 3 mos, but never did so.
A: You may potentially have a case. Seems like the circumstances need to be discussed further. A consultation may be worthwhile.
