Edwards, NY asked in Employment Discrimination, Employment Law and Personal Injury for New York

Q: I am being fired and red flagged from employment by a high school. Can i Sue?

I have been turning information over to the board member about how the building and grounds superintendent has been dumping chemical wast down to the septic tank and not properly taken care of. Also they had a 500 gallon fuel leak from the boilers that went down the drain to he leach field. Also i have been driving a plow truck that has had holes in the floor board that let it in sense 2010. I have been complaining about how it made be sick but they never fixed it, so i went to the union for help. So a board member went to see my father and told him to tell me to stop getting things going up there. Well all of the sudden this winter i was plowing with the plow truck and the next day i was fired for floor board holes that have been there for 8 years. They say i made them and they want me to resign and not to tell of the indecent to anyone or i i don't resign they will fire and red flag me. Can i Sue over this? All i have is witnesses from other custodians.

A: What does the board member say? Why did you contact the member instead of environmental regulators?

Did you ask for an accommodation of what might be a disability? If you are very sensitive to fumes that could have been a disability.

Will anyone in human resources confirm that you complained because you could not physically do your job?

Over 8 years you must have some very good performance evaluations right? Otherwise how will you respond if they claim your job loss is about performance?

Pay one or more employment lawyers for in person consultations so that you know all of your options and bring all paperwork associated with that job. It could take even a skilled lawyer hours to give you their best advice.
