Sanger, CA asked in Divorce, Child Custody and Domestic Violence for California

Q: My sister is married and has a 1 year sonThey live in husband's parents' home but he's kicking her out. Is this ok?

My sister is 20 and still in school. She's had no luck getting a job because of the awful economy in Fresno, CA. The husband is verbally abusive, and usually escalates arguments into yelling at her and calling her bad things. Recently he said she needed to leave. But it's clear the parents will take his side and ask her to leave. She doesn't have anywhere to go, I'm living on the charity of another family and our mother is abusive too. Is this illegal? If things get violent, and she has to leave, what about her son? Do they have the right to kick her out and keep the son? What can we do to avoid her homelessness, and to avoid losing her son? She doesn't have savings, and isn't able to get a job until she finishes her training program at Paul Mitchell school in Fresno.

A: She should contact the Marjaree Mason Center. It's a domestic violence shelter in Fresno that provides free shelter and legal assistance to victims of domestic violence. Children are welcome there.

If she needs an attorney in Fresno, I'd recommend Kristin Gates or Jennifer Lawton.
