Q: Rear ended on the hwy in Florida totaled car/Insurance wants to pay 5dys rental/plus car.What are we owed?! It's 21days?

Hi on Aug 1 my husband was driving our Unregistered but insured in California SUV on the hwy in Florida when we got rear ended by a careless driver/Police report. We have major bumper damage as well as frame etc.I was taken to the hospital by ambulance/checked out and released..Insurance delayed for 20 days saying they couldn't speak to driver who was driving her father's car.They are now accepting liability and want to pay $4400 for SUV and $200/ for 5 day rental. We did not want to sue..Would like to know what we are entitled to?! How many days rental ?? and would they owe pain and suffering etc?? We understand the medical bill would be paid by our insurance and then recouped ( We had liability only with higher limits/no collision ).* We asked can we recoup the cost of the catalytic convertor that was installed a month ago and a starter my husband just installed to keep the car running.They said yes now no. What are we entitled to??! Thank you.

A: If they weren't ready on the rental it's on them. They pay rental until they were ready to put a check in your hand. Settlement should be for property damage only. You need to have follow up exams with your docs to document your injuries. For just a hospital visit it won't be much. On the catalytic they will say it was a repair, standard maintenance you say it improves the value. Starter probably no. Settle up on the property then file a complaint with the Fla Insurance Commissioner or whatever state they were out of.

Do not give statements over the phone. If you did, it happens.

Heads up--if it was your fault many bad things could happen for you driving a vehicle without registration. May even void your policy. Don't do it!
