Q: All 3 of my boys were in the same vehicle, and incident reports only mention 3 victims. Who was driving 2nd car?
My boys were in a car accident, 2 of them lost their lives. They were hit on the front passenger side at an intersection, and there was only a stop for the other people/cross street. But incident reports only mention 3 victims, which were the driver Chris, his passenger in front Angel, and his passenger in back Jacob. If all 3 boys were in the same car, then who was driving the 2nd car? Why isn't a 4 victim mentioned? Cars don't drive themselves, and if the other car was at fault, then why haven't they made any arrests? This happened in May of this year, we are already in September. The cops say they know who was driving the other vehicle, yet nothing has been done.

Any answer I give to your questions would be speculation, since I haven't read the report. Ordinarily, all persons, vehicles and owners of vehicles are listed on the report. If there are no arrests, it could be that a determination has not been made as to criminality, as opposed to an accident. It would be better to have an attorney read the report in order to give a more educated response.
A: Also, I would recommend having an attorney review the collision ASAP. If there is any possibility of a dangerous road/intersection contributing to the collision, you have 6 months from the date of the incident to file a Tort Claim with the responsible government agency. There is also a time limit in your UM/UIM policy, if any, although that can usually be overcome. Please get some knowledgeable legal advice.

not all accidents are criminal..........most accidents are negligence. However, a lawyer can try to put pressure where warranted into working with the police and DA and trying to get a filing/arrest.
