Oakland, CA asked in Car Accidents for California

Q: When pulling onto a road in CA, if your vehicle is partially in the lane and someone hits it, who is at fault?

I was pulling onto a road and someone pulled out from a driveway behind me and into the lane I was entering. My vehicle was about 50% in the lane when the car that came from the driveway behind me ran into the left side of me. There were not stop lights or stop signs in this area. Who is at fault?

A: There are not nearly enough facts in this post to even make a guess as to responsibility. However, if you want your car fixed, make a claim with your insurer. It's faster and easier than going through the other driver's carrier. If your insurer gets its money back from the other driver/insurer, it will refund your deductible. If you are injured, contact a PI attorney.
