Irvine, CA asked in Civil Rights for California

Q: I got civil claim letter from Michael Ira Asen for paying $500. Do I have pay the money?

I was in target around 6 months ago and I did not pay for somethings. The manager get my address but they didn’t call police and after two weeks they send a paper to my address for paying $500 in Michael Asen office . I paid $75 and I can’t pay the reminder. Do I have pay the reminder? Their office is sending me a letter ever month to pay the reminder.

A: You say you were in a Target store, and left without paying for some of the things you took out of the store. You do not say you either took back the items you didn't pay for, so I must presume you kept them. Then Target's lawyers sent you a bill for $500, in response to which you made a payment of $75.00. I am wondering what you told the store manager in order to keep from being arrested at the time you left the store.

By paying the $75 you acknowledged that the bill was legitimate, and thereby obligated yourself to make payments on the account until it is paid in full. Rather than charging you with the theft of the items, the Target store gave you the opportunity to make payments until your bill is paid up.

So yes, you do have to pay the balance due for the items you kept.

A: You really do not provide enough information for a complete response. What was the value of the items you took? Was it intentional or accidental, the taking? Did you ever pay for the goods? What does the bill include? Does it include fees for the attorneys?
