Biloxi, MS asked in Divorce, Estate Planning and Family Law for California

Q: I was wondering what all i can get out of my husband in the divorce

I was wondering what all i can get out of my divorce? My husband was an extremely emotionally abusive person and there has been times in which he was physically abusive. He cost me my job by calling my boss and accusing me of having an extramarital relationship with a coworker. The home and mortgage is in my name. All it says on the deed is my name "or" his name no "and" included. I pay all the bills despite him making 3x as much money as me and it requires me dipping into my military retirement and benefits. All he spends his money on is alcohol and food for the house. I live in California and would like some more information please

A: The family code in California has a section which states that all community property is divided 50-50 between the parties.
