New Smyrna Beach, FL asked in Civil Litigation, Contracts, Consumer Law and Criminal Law for Florida

Q: I was deceived in a business transaction and signed two titles to vehicles I owned for someone to sell on consignment.

I sent two trailers out of state to a trailer dealer who is going to sell them on consignment and sent the signed titles. He had promised he was going to pay me and has not. I don’t know if he sold them but he was supposed to pay me nonetheless for the trailers at delivery and he did not. There is no contract it was all verbal. I’m only 26 years old. The other party is approximately 70 and I feel like I’ve been deceived and taken advantage of. He told me on his charm and expertise in business and told me it had to be this way or he couldn’t help me sell them and us continue to do business. My mom told me this is theft by deception. What should I do? The value of one is $20k and the other 30K

A: This does not appear to be a criminal case…it is a civil law issue in contracts…you should immediately communicate you desire not to sell these trailers to the consigned.

A: The best way to handle this is to hire an experienced Florida lawyer who is capable of locating the thief and your two trailers and convince his to stop the transaction and send your trailers back, immediately.
