Newark, CA asked in Employment Discrimination and Employment Law for California

Q: Hi. I got ill at work and I needed some medical attention asap. And my boss refused to help me.

He refused to help when I ask if he can take me and he said no then I asked if I can take the vehicle I drove to the job and he said no. He even told my co-workers to not help me in anyway. As a co-worker came up to me to check on me as I was laying on the ground in so much pain and ask me if I'm ok. I told him no I need medical attention asap. My co-worker then tells me I'm sorry I wish I could help but the boss told us not to help you. I didn't know what to do after hearing that. I called another boss to pick me up. I need help because I was stranded at the job site without any help or transportation. The other boss comes a while later and I'm in so much pain that I can't do anything. I had hard time getting in the truck and the other boss takes me to my personal vehicle instead of the hospital. I get in my truck and then I drove and got on the freeway and from there in San jose I drove to fremont hospital 2hr for 20 min I was admitted for 6 days bacterial infection in r hand got to

A: Your employer does not have a legal duty to attend to your medical needs that might occur while you are at work unless the workplace was at least in part the cause of the condition. The employer can legally require you to call an ambulance or a personal friend. The employer morally should care enough about you to see to it that you got immediate medical attention, but legally does not have that obligation.

Good luck to you.
