Pasadena, CA asked in Employment Law for California

Q: What is the amount of hours there should be between shifts ? If I use my phone for work do I get reimbursed?

I often am scheduled to close and open so I'm off by 11 to 1115 and back by 7 am. And I had been using my phone to send pics to district Manger per my manager.

A: Unless you are in a union that has negotiated something better, under California law there is no minimum amount of time you must have off between shifts. Your employer can ask you to even work back-to-back shifts if it wants as long as you are properly paid overtime if it is earned.

As to your other question, you should be reimbursed for the percentage of the usage charge you use your phone for business purposes. For instance, if you use your phone half the time for work purposes, your employer should reimburse you half the cost of your monthly charge for service.

If you are not an exempt employee, you should also be paid for any time you are on your phone for business purposes when you are not "on the clock."

Good luck to you.

A: You are entitled to reimbursement for your cell phone use. Typically a percentage of your bill.

There is no minimum time off between shift. Instead, the legislature has mandated overtime for work more than typically 8 hours per day as a remedy. Unfortunately, you can have a shift end at midnight and the next day's shift start immediately.
