San Francisco, CA asked in Civil Rights and Education Law for California

Q: Need legal advice on disabled child harassed at school by staff and students, as well as staff discrimination

Disabled child was verbally(shouted), physically (minor bruises), emotionally (threatened), psychologically (traumatized/scared), and sexually harassed (forceful inappropriate touch in private area with evil intention to cause harm) by a teacher, and bullied (injured in private area), ridiculed and mocked by students.

I believe the staff was well aware of all this abuse and bullying occurrences and NEVER informed the parents at all of the hostile learning environment the child was enduring.

The school staff is untrained in working with special needs students, as evident by the mistreatment; again NEVER informed the parents that they are untrained and cannot accommodate the needs of special needs students.

A: This is not the place for you to get the help you need.

You need a lawyer who is familiar with the needs of students like your child, and knows how to navigate the educational system with regard to the special needs of children like yours.

There are some very good lawyers in your area who can advise you under your circumstances. All you need to do is a Google search for lawyers for special needs children, and you should see several good leads you can check out. I'm sure you will be able to find several good law firms and lawyers who would be willing to help you.
