Q: Question regarding counting overtime twice because of working over 8 hours a day and over 40 hours a week.
I work in California as an hourly employee:
In a normal week, I work 5 days for 8 hours each day.
If on Monday I work 9 hours, I will receive 1 hour of overtime.
But if I work the rest of the week as normal, 8 hours a day, does the last hour in that week count as overtime since I've now gone over 40?
In short, should the time card reflect 2 hours of overtime?
No, you do not get two hours of OT in the situation you posted about. You are paid OT for either working more than 8 hours in a workday or 40 hours in a workweek.

A: Overtime is counted either based on going over 8 hours per day OR 40 hours per week. You cannot calculate it both ways and add it together.
