Q: My employer is 2 weeks late paying me. Is there a way to claim the $100 penalty for late payment.
I work for the Riverside school district. This is the 1st time I have not been paid on time. I was due to get paid December 20, 2022. I was told a check will be made tomorrow 01-03-23 and will be mailed out.
A: File a complaint with the California Labor Commissioner.
If the employer does not pay it you can file an administrative wage claim with the California Division of Labor Standards Enforcement, also known as the Labor Commissioner's Office. It costs nothing to file.
Before you bring such an action, know that retaliation can occur in many ways you would never be able to prove was retaliation. You need to decide if $200 is worth it.
