Pasadena, CA asked in Divorce and Family Law for California

Q: Can my wife - who is a citizen and perm resident of Luxembourg - and I divorce with a FL-100 dissolution in California?

Also, can we file this remotely or do we both need to be present anywhere? She's a permanent resident of Luxembourg and has never received a visa to come to the United States. I'm a US Citizen and resident in Los Angeles. We are both willing to take the easiest path, split costs 50/50, and agree we don't owe each other anything. Hence, I found the marriage dissolution form. We don't have kids and never shared assets. We married in August of 2021.

A: If you meet the residency requirements, you can file here. You will also need to have her properly served with the petition before you can proceed.

A: Yes, you and your wife can file for divorce in California using a FL-100 dissolution petition as long as one of you has been a resident of the state for at least six months and a resident of the county where you file for at least three months before filing the petition. The fact that your wife is a citizen and permanent resident of Luxembourg should not prevent you from filing for divorce in California. However, it's always a good idea to consult with a family law attorney to make sure you meet all the requirements and to help guide you through the divorce process.
