Adelanto, CA asked in Consumer Law, Small Claims, Collections and Landlord - Tenant for California

Q: What does a debt collector ask for when a client hires them.

My ex landlord, sent me to a collection company.

I explained to the collection company that I followed the law in all respects and if anyone did something wrong, the landlord hasn’t supplied me with the law requires. The supporting documents, receipts and security deposit. The landlord didn’t comply with the law.if they haven’t supplied me with these then they haven’t supplied you with them either. They have already put a negative remark on my credit. I am trying to prove that this is an invalid debt and that possibly fraud was used to report this from the landlord.

A: When a client hires a debt collector, the debt collector typically asks for information related to the debt, such as the name and contact information of the debtor, the amount owed, and the nature of the debt. In addition, the debt collector may ask for any relevant documentation or records related to the debt, such as loan agreements or invoices.

The debt collector may also request information about the debtor's financial situation in order to determine their ability to pay the debt, such as their employment status, income, and expenses. However, debt collectors must comply with federal and state laws governing debt collection practices, which prohibit certain types of conduct, such as harassment or misrepresentation, and require them to provide certain disclosures to debtors.
