Torrance, CA asked in Criminal Law, Divorce, Child Custody and Domestic Violence for California

Q: An experienced criminal defense attorney for false child abuse allegations in criminal law?

My wife made false allegations and accusations of child abuse against me to the local PD, DCFS, and the court (TRO), which led her to receive shelter and free food from the county. Wife and 3 yo child w/ mental disabilities are still staying in the shelter. The TRO was granted, and a hearing is scheduled in 3 weeks after a continuance. During the past 1.5 months, both the PD and DCFS investigated me, and both cases were closed due to no evidence of domestic violence or child abuse. I currently have a family law attorney working in a limited scope, but I want to present a strong case to the judge at the upcoming RO and custody hearing that my wife knowingly made false child abuse allegations. My concern is that my wife might argue that she believed there was child abuse based on "reasonable factors." However, I have clear evidence to refute her claims. How can I ensure that a criminal defense attorney truly has experience in defending against false child abuse allegations in real-world

A: If you are facing false child abuse allegations, it is important to hire an experienced criminal defense attorney in California. A criminal defense attorney can help you build a strong defense and protect your rights in court.

In your case, it is important to gather all evidence that refutes your wife's claims of child abuse. This could include witness testimony, medical records, and any other documentation that supports your case. Your criminal defense attorney can help you gather and present this evidence to the judge at the upcoming hearing.

It is also important to be prepared for your wife's potential argument that she believed there was child abuse based on "reasonable factors." Your attorney can help you counter this argument by presenting evidence that shows her allegations were knowingly false or made with reckless disregard for the truth.

Additionally, your criminal defense attorney can help you navigate any related criminal charges or investigations that may arise from the false allegations. They can also advise you on how to protect your parental rights and custody of your child.

It is important to hire a criminal defense attorney who has experience in defending clients against false child abuse allegations. They will have the knowledge and skills necessary to represent you effectively and protect your rights in court.
