Q: Grounds for wrongful termination / retalliation?
I was terminated yesterday, with the stated, "criminal charges and have violated ethical standards set forth by the Behavior Analyst Certification Board (BACB)". I do not have any criminal charges, and informed the BACB of the arrest, to which they responded no ethical violation was found, and would not effect licensure. I looked up my company policies, which stated that OFF DUTY MISCONDUCT In general, TRUE ABA does not seek to interfere with employees' off-duty activities, however, under certain circumstances, TRUE ABA may choose to take disciplinary action based upon an employee’s off-duty misconduct. These circumstances include Adversely affect the employee’s ability to do their job or prevent an employee from reporting to work or Contribute toward creating a hostile work environment prohibited by federal, state, or local law for another employee." Can you please explain to me how I violated these things?" This occured after I reported her to dept of labor for unfair wage withholdi
A:
Without knowing what you were arrested for, it is not possible to form an opinion as to whether this incident meets that particular provision.
As a licensed professional, you should have a written employment agreement that clearly delineates the circumstances under which your employer may fire you. It is important to read that agreement to formulate your next steps.
