Q: Found driver from hit-and-run 7 years later. Incident left me with permanent brain damage. What can be done?
Multiple requests for police report were either ignored, denied, or told couldnt locate. Finally 6 years later, right after s.o.l. is up, they find and provide it. Info in it helps me identify the driver, it also reveals that police failed to investigate, lied and contradicted themselves, and tried to cover up the lack of investigation by claiming that the 2 eyewitnesses and myself were being "uncooperative"...after providing lengthy/detailed and identical descriptions/accounts of what happened. To make matters even more absurd and unbelievable, while at the hospital, the Dr discovers I had a previous wrist injury that never healed correctly and so he assumes I faked the incident, attempting to get free treatment for the damaged wrist as a victim of a crime. Unbeknownst to me, he ends treatment, and nurses leave me alone for hours without food or water, while I'm suffering a TBI/concussion, traumatized/scared I may be a cripple now. I'm discharged at 3am told tests were negative...
A: There is a legal concept called "tolling" under which the running of the statute of limitations may be suspended. The facts you have provided are on the borderline as to whether you could benefit from tolling. It is an equitable concept and you would need to prove all of what you are claiming prevented you from pursuing your case in a timely manner. This matter will require sophisticated legal assistance, however, your damages are significant and you might be able to secure the assistance of a Personal Injury attorney in your area. I recommend you contact several attorneys in your area that practice this type of law, as soon as possible. Thank you for using Justia ask a lawyer.
