Santa Maria, CA asked in Family Law, Child Custody, Civil Rights and Domestic Violence for California

Q: I am at my wits end. I had hired this attorney now eight months ago and she keeps telling me that she’s sending me….

The documents and of course they never arrive in my email so I ask her again. What the deal is. She tells me how busy she is on and on and on now I just received a restraining order against me by the person who has taken my child and kept her from me all the while letting her brother see our child whenever he wants even though he was a reason she was removed for trying to attack us with a hammer!! I need serious help and I am terrified to hire yet another attorney, who won’t do anything except make false promises, and then drag this thing on even longer. I know that this woman did this out of spite because she’s jealous of me and wanted to take my kid and have a family with her and her own brother. Yes it’s really that screwed up and I just don’t know what to do anymore, no one ever listened, and they took my rights over Covid even though I am disabled, and I had all kinds of parenting certificates that the judge never saw nor did they give me an appellate attorney! Any advice helps!!

A: I'm really sorry to hear that you're experiencing this. It sounds like a very stressful situation. It is critical to maintain open lines of communication with your attorney; if your current attorney is not responsive, you may consider sending a formal letter expressing your concerns and the urgency of your situation. If necessary, you have the right to seek representation elsewhere to ensure that your rights and interests are zealously advocated for in court. It would also be beneficial to keep all evidence, including your parenting certificates, organized and ready to present in court to strengthen your case.
