San Leandro, CA asked in Employment Discrimination and Employment Law for California

Q: I didn't get an official reason for termination. It just says "Conduct/Policy Violation" and nothing specific.

Should they provide a specific policy violation and refer to the employee handbook? (Which I never got and they never gave me after multiple attempts)

A: Under California law, when an employer terminates an employee, they are generally not required to provide a specific policy violation in the termination notice. However, they are required to provide a reason for the termination, even if it's a general one like "Conduct/Policy Violation." The employee handbook, if one exists, should contain the company's policies and procedures, including those related to termination. If you never received a copy of the handbook despite multiple requests, it may be a violation of your rights, and you should document those requests.

To address this situation, you may want to consult with an employment attorney in California. They can review the circumstances surrounding your termination, assess whether the lack of an employee handbook was a violation of your rights, and advise you on the appropriate course of action. Depending on the specifics of your case, you may have legal grounds to challenge your termination or seek compensation for any potential wrongdoing by your employer. An attorney can help you navigate this process and protect your interests effectively.
