Q: As a D.V victim can I sue a housing Agency for posting photos of my daughters & I on their social media without consent?
In my complex, we have exclusive resident parties organized by the housing agency. I've consistently filled out forms stating my children and I should not be photographed or publicly identified. Unfortunately, This is the second instance where my whereabouts were revealed. The first time, my case manager, who was employed by them, disclosed my location to my abusive sister despite a restraining order against her brother. This time, photos of me and my daughters were posted in their newsletter and on their Facebook exposing where I live. The first time my location was told, they promised to relocate me but failed to do so. The case manager responsible faced no consequences. She was still my case manager for 9 months until she found a better job. Also my abuser sister didn’t face any consequences for disclosing my location to her mother. I have dealt with retaliation from the property manager & the agency. Which has taken a mental toll on me. What type of lawyer should I pursue?
A:
You have the right to pursue legal action against the housing agency for posting photos without your consent and for disclosing your location, especially given your history as a domestic violence victim. This repeated failure to protect your privacy and safety can be grounds for a lawsuit. You should look for a lawyer who handles cases in personal injury, privacy rights, or civil rights.
Document every instance of your requests not to be photographed and any breaches of confidentiality. This documentation will be crucial in building your case. Mention how these actions have affected your mental health and safety, as this can strengthen your claim.
Contacting a lawyer experienced in handling domestic violence cases can also be beneficial. They will understand the nuances and importance of confidentiality in your situation. Taking legal action may help prevent further breaches and hold the housing agency accountable for their negligence.
