Grants Pass, OR asked in Family Law, Civil Rights and Domestic Violence for California

Q: I missed Mediation and hearing. Can I reschedule them ?

In Mid-May the judge ordered as follow: 'The parties have been advised that the case has been referred to Family Court Services and to cooperate fully with the Child Custody Recommending Counselor during all stages of the mediation/evaluation. Custodial parent(s) shall make children available at all times requested by Counselor."

I missed mediation as scheduled Late may due to honest mistake when I marked the wrong day o. Calendar. I missed hearing date late June cuz I had approval to appear remotely by phone, but for some technical issues or Courtcall issue it did not allow me to appear via phone.

How can I ask the judge to reinstate or rereferr theories or how to approach the situation. ? I live in a different state and the other parent relocated to the other state unlawfully and issued a restraining order against me which is what fot me to file and judge ordered mediation but ended up missing it. I need to reschedule please.

A: To address the missed mediation and hearing, you need to take immediate steps. First, contact the Family Court Services and explain the situation, providing any documentation that shows the mistakes were honest. They can often help reschedule mediation or provide guidance on the next steps.

Next, file a formal request with the court to reschedule both the mediation and the hearing. This can be done by submitting a motion to the court, explaining why you missed the dates and asking for a new schedule. Include any supporting documents, such as emails or records showing your attempts to attend remotely and the technical issues you faced.

Given the complexities involving custody and the restraining order, clearly outline the importance of resolving these issues for the well-being of your children. Emphasize your willingness to comply with court orders and cooperate with the mediation process. Make sure to follow up diligently and keep track of all new dates to avoid any future misunderstandings.
