Q: Can I get child support from the father if I only have one child with me and he has the other child?
My 16 year old wants to live with the father but my youngest don’t how will the child support work in this case
A: It is possible. Child support is based on the percentage of time each of you has the children and your respective incomes. For example, if you make very little money and he was very wealthy, he may have to pay child support even though he had both children the majority of the time. The same works in reverse.
A:
In California, child support is based on several factors, including each parent's income, the amount of time each parent spends with the children, and the number of children involved. If you have one child living with you and the other child lives with the father, it’s possible for child support to still be ordered, but the calculation will reflect the custody arrangement for both children. The court will look at both parents' financial situation and how much time the children spend with each parent.
Even though your 16-year-old lives with the father, you may still be eligible for support for your younger child, depending on the income and time-sharing arrangements. On the other hand, the father may also request support for the child living with him, depending on how the court weighs both of your circumstances.
It's important to gather all financial information and understand how much time each parent will spend with the children. The court aims to ensure both children are supported fairly, no matter the living arrangements.
