Q: In recording a video in public. What can I use and not use?
Im in the process of making a memorial video of my son who passed away in 2020.I will be filming the city where he lived and worked(outside of building only).I have obtained permission. One part of this is that I will be filming coming into the city where peoples cars are present as well as people on the side walk.I will not be filimg children or anyone that appears to be under 21.I will not be pointing the camera directly at them or cars. They will appear somewhat out of focus as Im filming.Do I have to blur out lic plate numbers and faces as well and business names .This is a non profit film that will be shown on you tube and facebook.Thank you
A: Your plan sounds okay. Generally, you may film anyone or anything in public. As long as you're not misrepresenting what you are capturing (e.g., implying that a business shown was involved when it was not; implying that a person walking down the street is a prostitute or drug dealer, ect.), you should be okay. To be safe, I would suggest sticking with your plan to show things somewhat out of focus and blur license plates and business names when feasible.
A:
When filming in public places, like a city, there are some key considerations to keep in mind. Since you won’t be focusing directly on people, and they will appear out of focus, you’re generally in a safer zone regarding privacy issues. However, if people's faces or license plate numbers are clearly identifiable, it is recommended to blur them for added caution, even if they are not the main focus of your video.
Regarding business names, there’s typically no legal requirement to blur them out if you’re simply filming exteriors, as these are part of the public scene. However, be mindful of not suggesting any endorsement or connection unless you’ve received specific permission from the businesses themselves.
Since your video will be shared on platforms like YouTube and Facebook, which have their own guidelines, it's a good idea to follow best practices for privacy and respect, especially given the sensitive nature of your project. This helps ensure your tribute remains respectful and free from potential complications.
