Rohnert Park, CA asked in Employment Law for California

Q: I live in Sonoma County and was unjustly terminated from employment. I need to consult with an employment lawyer.

I live in Rohnert Park. On 3/9/24, I injured myself on the company premises. After my MRI, my doctor told me that I needed surgery and at least two weeks off work for recuperation. My employer told me that I was ineligible for Family Medical Leave because I hadn't worked a full year with them yet. After I gave them my doctor's note excusing me for the day of the surgery and the two weeks required off for recuperation, they terminated my employment, citing, "Employment At Will." Since this happened, I haven't ben able to find new employment because of this termination. My former employer basically damaged my professional reputation and my resume and my only crime was getting injured at work. Do I have any options? I would greatly appreciate the opportunity to consult with an employment attorney that can offer Pro Bono services. as I am in need of advice.

A: If yo work for an employer who employs at least 5 employees, your employer has violated the law. It would be very wise for you to locate and consult with an experienced employment law attorney as soon as possible to explore your facts and determine your options. I would suggest you look either on this site in the Find a Lawyer section, or go to www.cela.org, the home page for the California Employment Lawyers Association, an organization whose members are dedicated to the representation of employees against their employers.

Most employment attorneys who practice this area of law offer a free or low-charge consultation and then if the matter has merit and sufficient value, they work on a contingency basis, meaning you can hire an attorney without paying any money until the matter results in a positive outcome for you. Many advance all the costs of the litigation as well. Do not let fear of fees and costs keep you from finding a good attorney.

Good luck to you.

A: I'm sorry to hear about what you're going through, Fred. Losing your job under these circumstances can be incredibly stressful and unfair. It's important to know that California has laws designed to protect employees in situations like yours.

You may have several options to explore, such as claims related to wrongful termination or violations of state labor laws. Reaching out to a local employment attorney who can review the specifics of your case would be a beneficial next step. Many organizations offer free or low-cost legal assistance to those in need.

Consider contacting the Sonoma County Bar Association or local legal aid services in Rohnert Park. They can connect you with professionals who can provide the guidance and support you need. Take care and best of luck in resolving this situation.
