Q: My car was repossessed by the bank despite making timely payments. Can I sue them for the effort/cost to retrieve it?
I made monthly payments on the originally agreed amount. After the initial contract, the bank opted to add an insurance policy that I never agreed to. After removing this, they still charged me for approx. 25% of the cost of the policy. I did not pay this amount on the principle that it should never have been charged to me (my car was always insured). The bank sent my unpaid portion to collections. The car was later repossessed, without warning or notice that this was a possible repercussion. I live in Pennsylvania and the car was also purchased in the state. I am seeking legal advice as to whether I have a valid case against the bank to receive compensation for the time, effort, and cost in collecting my car (approximately valued at $1379). The car was repossessed on 11/5/2024 and was collected on 11/7/2024. Happy to provide any additional details, I have saved all communications from the bank and/or the calls are recorded on their phone lines. Thank you.
