San Leandro, CA asked in Employment Law and Banking for California

Q: If Cashapp rejected my check without letting me know or giving reason causing hardships am i able to sue for negligence

My Hr department messed up on my check, fixed it and deposited it in my account which was supposed to reach my account the same day. The money got rejected by cashapp but Hr was saying everything was sent and went through. Cashapp refuses to give me any information and says to wait 5 days. I escalate to talk to a manager on the third day. Due to my check still not arriving. Manager tells me the check was returned it will take 1-5 days to get to the depositor. My Hr department is saying it has not been returned. So i speak with someone else at cashapp and they say they have not seen any returns or rejections. That i should get my money and have to wait 5 days. So i open a new bank and setup direct deposit now work is saying it did get returned and i have to wait until Tuesday. Im late on my rent now and many other bills that are gathering late fees. So i have to wait 7 days from when i was promised my money. Is there any legal action i can take it has been a mental battle.

A: It sounds like you’re dealing with a frustrating and stressful situation, and it’s understandable that you want to know if there’s any legal action you can take. In California, to succeed in a negligence claim, you would generally need to prove that CashApp owed you a duty, breached that duty, and caused you measurable harm as a result. Financial apps like CashApp are often protected by their terms of service, which might limit their liability for delays or errors unless there’s clear evidence of mishandling or bad faith.

That said, your issue may potentially fall under consumer protection laws if you can show unreasonable delays or negligence in handling your funds. You could consider sending a formal written demand to CashApp requesting a detailed explanation and documentation of the rejection and return process. This would show you’ve taken steps to address the issue and could help you gather information to evaluate whether further legal action is possible.

It may also be worth looking into small claims court if the financial harm, including late fees, is substantial. However, your first step should be to carefully review the terms of service you agreed to when using CashApp. Keep documentation of all communication with CashApp and your HR department, as this can help if the situation escalates further.
