I do not know what it is you are asking. Due process boils down to notice and an opportunity to be heard, and it appears that has been given. You want to know if this is legal, and it is.
Suspect also refused the breathalyzer. No video-no breathalyzer.Chances of dismissal ?
Have license in NY but am moving back to FL.To transfer license from NY to FL i need to attend dui school.

Ask your probation officer. Misdemeanor probation is not usually transferred.

You need to get an attorney on your side swiftly. Leaving the state is not a good idea.

Your question is centered on "if". If the license is suspended in MS, it will be suspended in FL too. Once he has dealt with the dui in MS, then he should find out from the FL DMV what he needs to do.
he was young and stupid he don't do that stuff anymore but I think it was in another state that this happened how does he find out what to do..

Speak with your attorney about this. A suspension in OK will be an automatic suspension in FL.

They will be considering it. They will be checking the national crime indexing computer database, and if you had the dui in ohio a short time ago, you may be looking at a minimum of 10 days in jail. There are many other factors to consider and you really should get a private attorney.
