Q: FL St. 222.13 states death benefits are exempt from Ch7; but, I have read life insurance benefits (upon death) are not.

FL Statute 222.13 states death benefits payable to a specific beneficiary are exempt; but, I have read that life insurance proceeds (upon death) paid to a beneficiary are not exempt. Are not Life Insurance proceeds a death benefit? Thank You.

If you could sue them, that would be known as a "chose in action" and the trustee in your bankruptcy would get the proceeds to pay to your creditors, most likely.

The standard contract is 33 1/3 percent if no suit is filed, and 40% and up if suit is filed.

I am in the U.S. Navy and I was arrested on base for a false insurance claim for a car accident I got in in February.I never meant to commit fraud and the other persons insurance paid for everything because it was his fault.

You can sue them in small claims court but you cannot include damages for emotional distress.

You don't. You have already claimed the exemption. There probably has to be a hearing, and you would need to hire an attorney for that.

Q: Our Homeowners Insurance was not going to pay a claim so we hired a Public Adjuster and he recommended a lawyer who

Q: In US, how do we know that a health insurance company is named in a lawsuit?

I work in claims and I would like to know how I can find, from a law suit complaint, if the health insurance company is asked to intervene or to protect its lien by itself? Any specific paragraph that explains this? Please assist.
