Who is it that told you that someone owns the game? How would you sell something like a game?
Person took photos of my art work while in a class I was teaching at a local museum. She is now using images of my work on her website with my signatures removed. I have written a letter of cease and desist with no results. Please advise. Thank you.

I do not think it should be a small claims suit. What you should do is gather all the facts and go see an intellectual property attorney.

I do not know what you are asking. Generally, when a defendant is served with suit papers, there is also a summons which basically tells the defendant what needs to be done. It is always best to get an attorney for matters like this.

I want to start a company with a name that is already in use as a product by another company.
It would be used to make a similar product.
I am in a different country than that of the company/product in question.
Is that infringing?

Have you done a simple internet search with this precise question. I am sure that there are numerous things to read about this on the internet. There are numerous companies who will do this for you, and also do a search to find out if what you want to trademark is available.
I have found a trademark that has allowed its trademark to be infringed. The infringer is a separate company and the new mark has now become a registered trademark. My question is does the original trademark now have NO right to enforce infringment violations on it original trademark?
