Q: I sign for Claimant's consent to pay attorney and doctor fees. If I wont, my lawyer still get some of that money?

My lawyer represent me for Workers' Compensation. I know if I wont he will get pay by Maryland Worker's Compensation Commission, but what else i will need to pay with the contract I sign for my lawyer?

You lawyer is entitled to be paid for the work that he has put into your case. This is something that you should certainly discuss with your lawyer, in person.

Q: Can i see an out of state doctor if I have moved for work?

I settled in maryland but the medical stayed open. I now live in florida and am having some serious issues, how do i see a doctor?

You are entitled to see an out of state doctor of your choice. The catch is that the Doctor must accept Maryland Workers' Comp fee schedule.

Q: If I am receiving weekly checks from a workers compensation case and die what happens to the remaining weeks

Ordinarily the checks will stop and no family member will have access to the money. In some limited circumstances the money will flow to your estate.

Q: My employer filed an appeal, now I have to go to Circuit court. What can I expect from that?

Company originally tried to make this a VA. case although im a multi state driver they lost jurisdiction to MD. In feb. Now they filed an appeal

Now that an appeal has been filed the case will get much more involved. Q: What does the term " Passed for Settlement mean in a workers comp case?

Essentially, it means "your honor, there is no need to hear the pending issues at this time because the parties have come to a settlement agreement. The paperwork is being drafted and will be submitted in due course."

This is the battle that many workers' comp claimant have to endure. Quite often authorization is not given even when the doctor and you both know the need for the treatment is related to the work incident. Contact an attorney if you have not already.

The law does not clearly indicate whether you would be covered by workers' comp insurance if you were injured getting into your company vehicle while at home. More details would be needed.

Q: went to the DR my job sent me to now can i see my own DR.

the woman in charge of the workers comp will call their appointed Dr and have them change any medicals she does not agree with.then tell me i wont be paid if i do not do what the new papers say.this woman is getting in the way of my getting better. this is taking place on Marylands Eastern Shore

Whether an occupational injury is related to work is ultimately determined by the Workers' Compensation Commission after a hearing is held. It may not be advisable to settle the claim. Realize that for the most part your lawyer would not make any fee at all until the case settles, meaning that if the lawyer is telling you that it isn't a good idea/time to settle, that they are probably right.
