He says he doesn't need to have workers' comp as a sole proprietor - but what if he gets injured? Am I on the hook for it?
answered on Oct 28, 2016
There is always the possibility of you being on the hook. Even if he does have a workers comp policy you may be susceptible to a lawsuit. Workers comp usually only protects the employer who has the policy. So for you to benefit from maryland workers comp laws you would have to have your own... View More

20% whole body impairment rating wondering how it gets computed for ppd benefit.

20% whole person is 100 weeks of payment at the second tier. The payment amount depends on the year you were injured, your average weekly wage, and some other potential factors.
It is important to discuss this with your attorney because there are a number of legal factors to consider other... View More

It very well could depending on the laws of Pennsylvania. Maryland law may still apply depending on the type of employment, location of employers main office, work frequency, job duties.... It is best to talk to an attorney directly to go over your situation.

I injured my leg tripping at work. Started the clain process and recieved claim number. Went Dr for exam and he ordered an MRI to beable to give a diagnosis. My claim has been denied from an ER xray. Is seeking legal help my only course of action?
answered on Aug 29, 2016
It is your best course of action. Attempting to fight the denial on your own is going to be extremely difficult because of the complications that can arise and the particular evidence that you must come up with. It is important to file a claim with the insurance company as well as the Maryland... View More
Why do you have to pay wc back

The workers compensation insurer has placed a lien on the third party portion of you case. Call your attorney for an explanation or if you do not have one considering getting one.
I Have an order for lost wages from commission however its been over a month since decision and insurance company still wont pay, did not appeal and is virtually ignoring the claim for workers comp. The five-year limitation would apply to a modification of an initial order, rgenerally. Insofar as the commission apparently entered in order within that 5 year time frame, this would not appear to be an issue. I would suggest that you immediately consult with an experienced workers compensation... View More

The employer/carrier has time within which to pay the award. For example they have 30 days within which to file an appeal. If it is not paid when due, substantial penalties may attach. 20% of the value of the award, or 40% of the value of the award, depending on the delay. There may be other... View More

Do i have a case?? I'm a commercial painter all mylife.also same has to be done to right arm an hand next year as well.
answered on Jun 23, 2016
You could very well have a case depending on a few factors. Under Maryland workers comp law this would be an occupational disease developed from repetitive motion. I can certainly see how a painter would develop carpal and cubital tunnel syndromes. You would need to have a doctor indicate that... View More
