Q: I was arrested for a DUI associated with a car accident where I sustained some minor injuries. Aren't the police

In Minnesota, it is still currently a crime of Gross Misdemeanor Refusal, if you refuse to submit to an evidentiary breath test (Datamaster DMT) at the police station.

Q: If court is scheduled in Iowa for a minnesota resident, can the case get transferred to minnesota?

Court hearing is scheduled in Iowa but the person is a Minnesota resident. Is there a way to get the hearing/ case transferred so the resident doesn't have to leave their home state?

If the person is accused of violating Iowa law, then that person must answer to the State of Iowa.

Depends what you mean by "forced" urine sample. If they got a cup and you filled it without them doing the tarantella on your bladder, then it's not forced. But if it's serious enough for a warrant it's serious enough for you to get a hold of a minnesota criminal lawyer. If... View More

My sister's court appointed lawyer got angry when she asked him questions about her case, called her crazy and said she needed help. What should she do? She isn't crazy he was mad she questioned his motives.

It does not hurt to make the request, but do not be surprised if the prosecutor does not agree with the request. It is highly advisable to get an attorney to help you through this.

You should seek review of the impoundment order. The procedures are somewhat complicated so it is advisable that you seek legal counsel.

Q: Charged with a DWI, pled guilty to a careless, was on private property. Is this proper ruling? In MN is this proper?

because of guilty plea, medical bills are now my responsibility. Yet in MN, I believe that a person can not be found guilty of careless driving while on private property? The injured party had no seatbelt on and interfered with the driver which directly caused the accident!

You are apparently asking this after the entrance of a plea. When you enter a plea you give up certain rights. You ask if this is proper. You had an attorney, right? It might be too late, but it probably will not hurt to ask your attorney about this or go see a private local one.

Q: I was initially charged with a 2nd degree DUI in Minnesota and they confiscated my car for forfeiture.

I ended up pleading guilty to a 3rd degree DUI and now have a hearing for my car. First off, the car is not mine.....secondly since I pled to a 3rd degree dui don't they have to give it back?

"confiscated my car" "the car is not mine" Which is it? What does the owner say? Why don't you get a local attorney?
