Yes, as long as you are no greater than 3 years apart in birthdays. It is an affirmative defense.

The 13 year old got a concussion and his parents pressed charges on the 15 year old

Did they agree to fight or was the 15 year old just wanting to fight? It makes a difference and if the State really wants to play hardball they could charge the 15 year old with Injury to a Child which is a felony.

Probably not, but it may be determined by where you had sex. In Texas the age of consent is 17, with a 3 year window) but in other states the age of consent can be lower and then this would not even be an issue.

probation for truancy. almost 17. 4th time going to court.

If that is the only other criminal history that you have the chances are very small that you will go to TJJD.

They were told they can't be at our home doing this. Her mom dropped her off and does not listen either. We are fed up. This is affecting our family.

If you are less than 3 years apart it is a legal defense to the offense.

Not just no, but hell no. A 12 year old has no business being with a 17 or 18 year old. Plus he can be charged with Aggravated Sexual Assault of a Child. He could get life in prison for this offense. On the brighter side he was probably end up being someone's girlfriend in prison.

Date yes, although I find it disturbing, have any sexual contact, NO. Find someone your own age dating an 11 year old is creepy on your part.

It depends. If the 19 year old is less than 3 years older than the 16 year old it is an affirmative defense to the criminal charge. Once the 16 year old turns 17 everything is legal. Just wait until 16 year old turns 17.

Yes it is an affirmative defense if they are within 3 years of age and the sex is consensual.

Q: What's the worse that can be done to a 16-year-old who has a felony against him if there is little evidence against him?

He did break his probation but there is no evidence that he actually did the charge. Just a person's say.

Well obviously if he is on probation it has already been decided that he committed the offense. There is no guarentee that he will go to jail at all. If fact it is very unlikely that he will spend any time in detention other then when he was originally detained.

He picks her up from a sleep over, takes her to his home for sex, and returns her to her friends home. He is almost 18. A senior in high school.

My daughter is a 16 year old Sophmore.
