I don’t believe you are required to litigate anything, however you should discuss with your worker’s compensation attorney the consequences of not proceeding. If you are considering a settlement, that is also something to discuss with your attorney as it may affect your right to future benefits... View More

Q: If a motorcycle lane splitting me on the left collides with me when making a left turn in a parking lot who is at fault?

I am signaling that I am making a left turn and also do so when I see there is no oncoming traffic.

The answer is fact-specific and it is unclear to me how the incident occurred. Generally speaking, it is negligent to operate your vehicle in an unsafe manner so if you are making a turn when it is unsafe to do so, you may be found to be at-fault. If the other driver is making a claim against... View More

Car hit while parked. My insurance doesn't cover. SF police won't give me police report [Gov't Code 6254(f)] so I don't know who is responsible so I can't contact their insurance. Can't afford even an estimate. Car not drivable as-is. No one was in my car so... View More

You may want to contact the district attorney’s office, see if anyone has been charged and if a prosecutor has been assigned. Their liaison should be able to tell you if there is a victim witness assistance fund from which you can make claim. They may also be able to tell you how to get a copy... View More

Q: I was bit by a dog when i walked inside a dollar tree store. It wasn't a service animal even. Is dollar tree liable?

Some added info: The Dollar Tree only allows Service Animals inside. Apparently the store mgr was on vacation, maybe this is why the dog was not made to leave the building. The dogs owner was paying for her purchases at the register closest to the door, the dog was next to the lady. I walked in the... View More

You may have a better case against the dog owner, if you know their identity, since it is based on strict liability. However, for a claim against the business, you will need to prove they were negligent in some manner. Given that you apparently have not needed to obtain medical attention so far, I... View More

Assuming this occurred in California, there is a two-year statute of limitation quickly approaching for claims against a negligent third party. You should contact an attorney ASAP to evaluate your options.

Q: Not-at-fault Car Accident

My brother-in-law was in a 2-car vehicle accident a little over a year ago in California. He was found via his insurance agency to be not at fault, and neither party called the police to the scene of the accident. He is now receiving certified mail from the other party demanding a payment of... View More

It is nice that your brother-in-law’s insurance determined him not to be at-fault. However, unfortunately that finding is not binding on the other party. Your brother-in-law should make sure to document his communications with his insurance company so that he can refer back to it when necessary.... View More

My insurance covered the medical bill and no personal property was damaged. I did, however, lose two days pay due to the injury. If your claim is against a public entity, you will likely be required to comply with the 6-month claims statute. You should contact a knowledgeable attorney ASAP to evaluate your claim.
