Q: In the state of Ohio if you have a will does the estate need to go through probate court?

It really depends on the property that needs to be probated. Personal property held by a trust need not go through probate. Real Property that is held as a joint tenancy with rights of survivorship or property previously designated as a transfer on death designation need not go through probate.... View More

Q: My father passed away 5 years ago. He was survived by his 2nd wife (my step mom of course)& I do not talk to her at all

There are a few things that need to be answered before it is determined if you have rights:

1.) You need to find out if there was a will and you will need to produce the original copy to the probate court,
