Its possible. You have the right to sue the driver personally, although that option will likely not get you the results you deserve. Q: What’s an appropriate settlement amount for food poisoning ?

Diagnosed with food poisoning by hospital, out of work for a week. Had proof of the that it was the restaurant’s responsibility. I want to be fairly compensated but I also wasn’t to be fair to the company as well.
