Cumberland, MD asked in Employment Law and Employment Discrimination for Maryland

Q: If I'm already working for an company, can they fire me if a background check company doesn't provide a timely response

Let's suppose the background check company is the Federal OPM office, and the background check is for a standard public trust level job that doesn't require a secret or top-secret level clearance and that none of the jobs at your work site are classified. Further, Let's suppose the governments HR depart is infected by an Obama era black and indian/asian minority racist group that is purposely "Delaying" OPM background checks of white contractors so that they can disqualify them by pretending they don't have a valid background checks by "Delaying" them past the interm period to get more blacks and minorities into the government office?

A: This sounds like a hypothetical question. An employer can always come up with a reason to deny you a clearance, no matter how high or low the level of the clearance.

A: ...also, it doesn't matter if the background check is being done by OPM or a private company, the employer has the final say concerning approval. In spite of red flags.... Jared Kushner was given a security clearance because his employer...his father in law... said it was OK!
