A: You can ask for your employer to issue a stop payment and provide you with a cashier's check.

The fact the bank put a hold on the final check is a bad sign.

Depending on whether the check is ultimately rejected, you may be entitled to waiting time penalties for each day late up to a max of 30 days.

A: It is not entirely clear what has happened. If the action by the bank is unrelated to a stop payment or non-sufficient funds issue then this is likely an issue with your bank, and you will have to speak to a banking attorney to get your answer. If the delay was caused by some act of your employer, then you may be entitled ti a penalty under Labor Code Section 210 of $100. The issue then would be whether the legal action necessary to get that penalty is worth the time, money and energy, as well as the disappointment or anger of your employer. That is your call.

Good luck to you.
