Q: Good morning. If the statute of limitations has expired can I be investigated again with different evidence at work?

A: The statute of limitations in no way binds your employer regarding what it can or cannot investigate. You can be fired for something you did 10 years ago if it wishes to do so. The only thing the statute of limitations limits is the filing of a lawsuit or criminal charge. It is not a limit on employer discipline.

A: I agree with Neil. Employment is at will in California. The employer could fire you for something 30 years ago.
